Terms and Conditions
EventTrack — a service by WRU Design Agentur UG (haftungsbeschränkt)

1. Scope
These Terms and Conditions (T&Cs) apply to all contracts between WRU Design Agentur UG (haftungsbeschränkt) (hereinafter "Provider") and the users of the SaaS platform EventTrack (hereinafter "Customer").
EventTrack provides an API-based event tracking and logging service for software projects.
These T&Cs apply to both consumers and business customers.
2. Subject Matter
The Provider offers the Customer access to an API-based event tracking and logging platform via the Internet. Use is permitted exclusively within the scope of booked, paid plans.
3. Contract Conclusion and Registration
Use of EventTrack requires registration. By completing the order process, the Customer submits a binding offer to conclude a usage contract. The contract is concluded when the Provider confirms the order via email.
4. Contract Term and Termination
The contract term is one month and automatically renews for another month unless terminated by the Customer before the end of the current term.
Termination can be made at any time without notice via the platform or by email to info@eventtrack.dev.
5. Prices and Payment Terms
Use of EventTrack is only possible within the scope of paid plans. The current prices are listed on the Provider's website.
Billing is monthly in advance via the payment service provider Stripe Payments Europe, Ltd.. The Provider does not store any payment or credit card data.
6. Right of Withdrawal for Consumers
Consumers generally have a statutory right of withdrawal.
For digital content and services not delivered on a physical medium, the right of withdrawal expires if the Consumer has expressly consented that the Provider may begin executing the contract before the withdrawal period expires, and the Consumer has acknowledged that they lose their right of withdrawal upon giving this consent.
During the order process, the Consumer is asked to agree to this provision.
7. Availability and Support
The Provider strives to ensure uninterrupted availability of the service. However, restrictions due to maintenance work or technical issues cannot be excluded.
Support inquiries are accepted on weekdays from Monday to Friday between 8:00 and 18:00 via email at info@eventtrack.dev.
8. Liability
The Provider is liable without limitation in cases of intent and gross negligence. In cases of slight negligence, the Provider is only liable for breach of an essential contractual obligation (cardinal duty), limited to typical and foreseeable damages.
Further liability is excluded. The limitation of liability does not apply to injury to life, body, or health.
9. Place of Jurisdiction and Applicable Law
All disputes arising from or in connection with the contractual relationship shall be governed by the laws of the Federal Republic of Germany.
The exclusive place of jurisdiction is Wiesbaden, provided the Customer is a merchant or a legal entity under public law.
10. Language
These T&Cs are provided in both German and English. In case of doubt or legal dispute, the German version shall prevail.
11. Right of Withdrawal for Consumers
Right of Withdrawal
Consumers have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the date of contract conclusion.
To exercise the right of withdrawal, the Consumer must inform the Provider (WRU Design Agentur UG (haftungsbeschränkt), Geisenheimer Str. 9, 65197 Wiesbaden, Germany, Email: info@eventtrack.dev) by means of a clear statement (e.g. via email) of the decision to withdraw from this contract.
Consequences of Withdrawal
If the Consumer withdraws from this contract, the Provider shall reimburse all payments received from the Consumer without delay and at the latest within fourteen days from the date on which the notification of withdrawal from this contract is received.
Exclusion of the Right of Withdrawal
The right of withdrawal expires in the case of contracts for the delivery of digital content if the Consumer has expressly agreed that the Provider begins with the execution of the contract before the withdrawal period expires and the Consumer has acknowledged that they lose their right of withdrawal upon the start of the execution of the contract.
